Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the GetCompliant service operated by STRAVIAZ IMPACT S.R.L. ("GetCompliant", "we", "us", "our") at getcompliant.website (the "Service"). By accessing or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

GetCompliant is an automated technical scanner that examines publicly accessible websites and produces a structured report (the "Report") covering signals relevant to:

• The General Data Protection Regulation (Regulation (EU) 2016/679)
• The European Accessibility Act (Directive (EU) 2019/882) and the WCAG 2.1 AA technical standard
• Discoverability by generative AI assistants ("GEO"), including bot crawl-permission signals and structured-data presence

The Report identifies the presence or absence of specific technical signals on the scanned website, provides a numeric score per category, and suggests technical remediation steps. The Service is delivered "as is" based on automated analysis of publicly available technical signals.

2. Eligibility

You may use the Service only if you are at least eighteen (18) years old and have the legal capacity to enter into a binding contract in your jurisdiction. If you use the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.

3. Acceptable Use

You may use the Service to scan websites that you own, that you operate, or that you have lawful authorisation to assess. You must not use the Service to:

• Violate any applicable law, regulation, or third-party right;
• Submit URLs that you have no authority to test where the relevant terms of service or law require such authority;
• Circumvent or attempt to circumvent rate limits, security measures, or any technical or contractual protection of the Service;
• Interfere with the integrity or performance of the Service or use it in any way that could harm us or other users;
• Resell, redistribute, rebrand, or hold out the Service or the Reports as your own product without our prior written permission; or
• Use the Service to develop a competing product or service.

We may suspend or terminate your use of the Service for any breach of this Section.

4. No Legal Advice

The Reports are technical assessments produced by automated tools. They are not legal, accounting, accessibility, or compliance advice. Whether a website meets any specific legal or regulatory standard is a matter of professional legal interpretation that the Service does not provide. You are solely responsible for any decisions or actions you take based on a Report. We strongly recommend that you obtain qualified legal counsel before relying on a Report for any regulatory submission, audit response, or other high-stakes purpose.

5. Purchase, Pricing, and Payment

5.1 Free Preview and Paid Reports

The Service offers a free preview that displays the score and a sample of findings for each module. The complete Report, including all findings, recommended remediation steps, and the downloadable PDF version, is made available upon payment.

5.2 Prices

Prices are displayed in EUR on the Service and are exclusive of any applicable value-added tax (VAT), which is calculated and added at checkout according to the customer's location and status (B2B or B2C). For B2B customers established in the European Union outside Romania who provide a valid VAT identification number, the reverse-charge mechanism applies pursuant to Article 196 of Directive 2006/112/EC.

5.3 Payment Processor

Payments are processed by Stripe Payments Europe, Ltd. By proceeding to checkout you also accept Stripe's terms of service and privacy policy, available at stripe.com/legal.

5.4 Delivery

The complete Report and the PDF version are made available immediately upon successful confirmation of payment by the payment processor. The PDF is also sent to the email address provided at checkout.

5.5 Right of Withdrawal

The Service is a digital content product supplied in immediate fulfilment of your order. In accordance with Article 16(m) of Directive (EU) 2011/83/EU on consumer rights, as transposed into Romanian law by Government Emergency Ordinance 34/2014, by completing your purchase and expressly confirming that you wish to obtain immediate access to the Report, you give your prior express consent and acknowledge that, as a result, you lose your right of withdrawal once delivery has begun.

5.6 Refunds

Notwithstanding Section 5.5, we may at our discretion issue a refund in the event of a demonstrable Service malfunction that prevented delivery of a usable Report. To request a refund, contact hello@getcompliant.website within fourteen (14) days of purchase with a description of the issue.

6. Intellectual Property

6.1 Our Content

The Service, including its underlying scanning logic, scoring methodology, finding taxonomies, copy, branding, and design, is owned by STRAVIAZ IMPACT S.R.L. and is protected by applicable intellectual property and unfair competition laws. Nothing in these Terms transfers any of these rights to you.

6.2 Your Reports

Subject to your full payment, we grant you a worldwide, non-exclusive, non-transferable, royalty-free licence to use the Report for the internal compliance, remediation, audit, legal, and procurement purposes of the organisation that operates the scanned website. You may share the Report with your internal teams, contractors, consultants, and legal counsel acting on your behalf. You may not publish the Report verbatim, resell it, or rebrand it as the work of another party without our prior written consent.

6.3 Your Submissions

By submitting a URL for scanning you represent and warrant that (a) the website is publicly accessible without circumventing access controls and (b) you have any authorisation required by applicable law or by the website's own terms to submit it to an automated technical assessment.

7. Service Availability

We aim to provide a reliable Service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to scheduled maintenance, upstream infrastructure outages, or unforeseen incidents. We are not liable for delays or interruptions caused by events beyond our reasonable control, including force majeure events and third-party infrastructure failures.

8. Disclaimers

To the maximum extent permitted by applicable law, the Service and the Reports are provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, non-infringement, or that the Service will detect every compliance issue affecting the scanned website.

We do not warrant that the Reports will be sufficient to demonstrate compliance with any law or regulation, nor that any score, finding, or recommendation will be accepted by a regulator, auditor, or court. Compliance status remains the responsibility of the website operator and their qualified advisors.

9. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall STRAVIAZ IMPACT S.R.L., its directors, employees, contractors, or agents be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, revenue, data, goodwill, or business opportunity, even if advised of the possibility of such damages.

Our aggregate liability for any claim arising from or relating to the Service or these Terms, whether in contract, tort, or otherwise, shall not exceed the greater of (a) the total amount paid by you to us in the twelve (12) months preceding the event giving rise to the claim or (b) one hundred Euro (€100).

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable mandatory law, including liability for fraud, gross negligence, intentional misconduct, or death or personal injury caused by our negligence. Consumer rights granted under Romanian and European Union law remain unaffected.

10. Indemnification

You agree to indemnify, defend, and hold harmless STRAVIAZ IMPACT S.R.L. and its directors, employees, contractors, and agents from and against any claim, demand, loss, liability, or expense (including reasonable legal fees) arising from or relating to (a) your use of the Service, (b) your breach of these Terms, or (c) your violation of any law or third-party right, including your warranties in Section 6.3.

11. Term and Termination

These Terms remain in force as long as you use the Service. We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have breached these Terms or otherwise pose a risk to the Service, to us, or to other users. Sections 4, 6, 8, 9, 10, 12, 13, and 14 survive any termination.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of Romania, without regard to its conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts of Pitești, Argeș, Romania.

Where you are a consumer resident in the European Union, the preceding sentence does not deprive you of the protection afforded by mandatory provisions of the law of your country of habitual residence, including the right to bring proceedings in the courts of that country.

13. EU Online Dispute Resolution

Consumers resident in the European Union may also access the European Commission's online dispute resolution platform at ec.europa.eu/consumers/odr. Our email address for this purpose is hello@getcompliant.website.

14. Changes to These Terms

We may revise these Terms at any time. The currently applicable version is identified by the "Effective" date at the top of these Terms. We will provide reasonable advance notice of material changes by a prominent notice on the Service or by email to the address associated with your most recent purchase. Continued use of the Service after the effective date of revised Terms constitutes acceptance of the revised Terms.

15. Severability and Entire Agreement

If any provision of these Terms is held to be unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be interpreted, to the maximum extent permitted by law, so as to give effect to the parties' original intent. These Terms, together with the Privacy Policy and the Cookies Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements, communications, or proposals concerning the Service.

16. Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms to any successor entity in connection with a merger, acquisition, reorganisation, or sale of substantially all of our assets, subject to applicable law.
